देशात ग्रामीण मजुरांना अकुशल रोजगाराची हमी 1977 पासून कायद्यान्वये देणारे महाराष्ट्र हे एकमेव राज्य.
भारत सरकारने ग्रामीण रोजगाराचे विविध कार्यक्रम (जवाहर रोजगार योजना, एकात्मिक ग्रामीण विकास कार्यक्रम, संपूर्ण ग्रामीण रोजगार योजना इ.) निधीच्या उपलब्धतेनुसार राबविले होते मात्र या कार्यक्रमात रोजगाराची हमी नव्हती, तर फक्त रोजगारांची उपलब्धता होती.

महाराष्ट्राचा रोहयो कायदा, त्याची यशस्वी अंमलबजावणी, माहितीच्या अधिकाराचा कायदा व सद्यस्थितीच्या अनुषंगाने अभ्यास करुन केंद्रशासनाने संपुर्ण देशासाठी दिनांक 5 सप्टेंबर 2005 पासून महात्मा गांधी राष्ट्रीय ग्रामीण रोजगार हमी कायदा 2005 अमलात आणला.
संपूर्ण देशातील ग्रामीण कुटुंबांना वित्तीय वर्षात 100 दिवस प्रती कुटुंब अकुशल रोजगाराचा हक्क प्राप्त.
राष्ट्रीय कायद्याची अंमलबजावणी दिनांक 2 फेब्रुवारी 2006 पासून टप्प्याटप्प्याने सुरु व दिनांक 1 एप्रिल 2008 पासून देशातील सर्व जिल्हयांचा समावेश.
मनरेगा एकात्मक व प्रमुख कायदेशीर बाबी –
केंद्रीय कायदयातील कलम 28 प्रमाणे राज्याचा कायदा केंद्रीय कायद्यापेक्षा कमी दर्जाचा नसावा व तो केंद्रीय कायद्याशी सुसंगत असावा अन्यथा संसदेने पारित केलेला कायदा राज्याला आपोआप लागू.
महाराष्ट्र शासनाने केंद्रीय कायद्यातील कलम 28 प्रमाणे राज्य कायदा सुसंगत करणे व केंद्र व राज्य कायाद्यातील ज्या बाबी मजुरांसाठी अधिक हितावह आहेत त्या तशाच पुढे चालू ठेवणे व अशाप्रकारे राज्य कायद्यातील सुधारणा करण्याचा व अशा सुधारित राज्य कायाद्यांतर्गत राबविण्यात येणा-या योजनेस महाराष्ट्र ग्रामीण रोजगार हमी योजना संबोधण्याचा निर्णय डिसेंबर 2005 मध्ये घेतला.
राज्य कायद्यात सुधारणा करणारा अध्यादेश दिनांक 31 ऑक्टोबर 2006 ला काढण्यात आला.
अध्यादेशाचे कायद्यात रुपांतर दिनांक 29 डिसेंबर 2006 ला विधिमंडळाची व मा. राज्यपालांची मान्यता घेऊन केले.
केंद्रीय कायद्याखाली ज्या दिनांकास राज्यातील ज्या जिल्हयाचा समावेश त्या दिनांकास सुधारित राज्य कायद्यातील कलम 16 (ब) त्या जिल्हयास लागू व महाराष्ट्र ग्रामीण रोजगार हमी योजना त्या जिल्हयात सुरु एप्रिल 2008 पासून सर्व जिल्हयांना लागू.
राज्याच्या कायद्यातील सुधारणांमुळे महाराष्ट्र हे देशातील इतर सर्व राज्यांप्रमाणे केंद्रीय निधी मिळण्यास पात्र.
26 जुलै 2011 पासून महाराष्ट्र ग्रामीण रोजगार हमी योजनेचे नाव महात्मा गांधी राष्ट्रीय ग्रामीण रोजगार हमी योजना – महाराष्ट्र असे संबोधण्यात येत आहे.
