माहितीचा अधिकार अधिनियम २००५ खाली पहिले अपील करण्यासाठी काही सुचना

पहिले अपील कधी करावे

1. जर लोकमाहिती अधिकार्‍याने तुमचा माहिती मिळवण्यासाठीचा अर्ज फेटाळला असेल तर
2. जर सरकारी अधिकारी ३० दिवस किंवा ४८ तासांच्या* आत माहिती पुरवण्यास असमर्थ असेल तर
3. जर सार्वजनिक आस्थापनाने माहितीचे अर्ज स्वीकारण्यासाठी किंवा माहिती पुरवण्यासाठी सहाय्यक लोकमाहिती अधिकारी/लोकमाहिती अधिकारी नियुक्त केला नसेल तर
4. जर सहाय्यक लोकमाहिती अधिकार्‍याने तुमचा माहिती मिळवण्यासाठीचा अर्ज स्वीकारण्यस किंवा लोकमाहिती अधिकार्‍याकडे पाठविण्यास नकार दिला असेल तर
5. जर लोकमाहिती अधिकार्‍याने दिलेला निकाल समाधानकारक नसेल तर
6. दिलेली माहिती अपूर्ण, चुकीची किंवा दिशाभूल करणारी आहे असे वाटत असेल तर
7. जर सरकारी अधिकार्‍याने माहितीचा अधिकार अधिनियम २००५ अंतर्गत माहिती देतांना घेतलेली फी अवाजवी आहे असे तुम्हाला वाटत असेल तर

पहिल्या अपीलासाठीची मुदत

1. राज्य/ केंद्रीय लोकमाहिती अधिकार्‍याने केलेला शेवटचा पत्रव्यवहार (निकाल किंवा विनंती नाकारल्याचे पत्र) मिळाल्याच्या तारखेपासून किंवा ठरवून दिलेली तारीख उलटल्यावर ९० दिवसांच्या आत
2. अपीलकर्त्याला माहिती न देण्याचे कारण प्रथम अपीलीय अधिकार्‍यास मान्य असल्यास ९० दिवसांनंतर ही अपील करता येते.

पहिल्या अपीलासाठी अर्ज लिहिणे

1. एका पांढर्‍या कागदावर तुमचा अर्ज लिहा
2. अर्ज हस्‍तलिखित किंवा टंकलिखित ही असू शकतो.
3. अर्ज इंग्रजी किंवा हिंदीत (केंद्रीय माहिती आयोगाकडे पाठवायचा असेल तर) किंवा त्या विशिष्‍ट राज्याच्या (राज्य माहिती आयोगाकडे पाठवायचा असेल तर) अधिकृत भाषेत असावा.
4. हवी असलेली माहिती अर्जात विहित नमुन्यात स्पष्टपणे नमूद करावी.
5. विनंतीअर्ज, फी दिल्याचा पुरावा, लोकमाहिती अधिकार्‍याने दिलेली पोचपावती, अर्जावर दिलेला निकाल, इ. कागदपत्रांची स्वसाक्षांकित छायाप्रत अर्जासोबत जोडा.
6. प्रत्येक कागदपत्राच्या छायाप्रती तयार करा आणि त्या स्वतःच्या संदर्भासाठी जपून ठेवा.

पहिला अपील अर्ज कोठे पाठवावा

• अर्ज त्याच आस्थापनाच्या प्रथम अपीलीय अधिकार्‍याकडे दाखल करावा.
• श्रेणीमध्ये प्रथम अपीलीय अधिकारी लोकमाहिती अधिकारी आणि सहाय्यक माहिती अधिकारी यांच्यापेक्षा वरिष्ठ दर्जाचा अधिकारी असतो जो आवश्यक ती माहिती पुरवितो किंवा अर्ज नाकारू शकतो.
• पहिला अपीलीय अर्ज दाखाल करताना त्यावरील प्रथम अपीलीय अधिकार्‍याचे नाव, फी, फी देण्याची पद्धत तपासून पहा. (काही राज्यांमध्ये पहिले अपील मोफत असते तर काही राज्यांत त्यासाठी फी आकारण्‍यात येते.)

पहिला अपील अर्ज कसा पाठवावा

• अर्ज केवळ रजिस्टर पोस्टाद्वारेच किंवा स्वहस्तेच पाठवावा.
• कोरियर सेवा वापरणे टाळा.
• तसेच अर्जासोबत पोचपावती देखील जोडा.

माहिती पुरविण्यासाठी कालमर्यादा:

• सर्वसामान्य प्रकरणांच्याबाबतीत निर्णय साधारणतः ३० दिवसांत दिला जातो. अपवादात्मक स्थितीत ही मर्यादा ४५ दिवसांपर्यंत जाऊ शकते.
• प्रथम अपीलीय अधिकार्‍याकडे अर्ज पोहोचल्याच्या दिवसापासून निर्णयासाठी कालमर्यादा मोजली जाते.

Some suggestions for making the first appeal under the Right to Information Act 2005
When to make the first appeal

If your application for information has been rejected by the Public Information Officer

1. If a government official is unable to provide information within 30 days or 48 hours *
2. If the Public Establishment has not appointed Assistant Public Information Officer / Public Information Officer to accept or provide information application
3. If the Assistant Public Information Officer refuses to accept your application for information or sends it to the Public Information Officer
4. If the result given by the Public Information Officer is not satisfactory
5. If you think the information provided is incomplete, inaccurate or misleading
6. If you feel that the fee charged by a government official for providing information under the Right to Information Act 2005 is unreasonable

Deadline for first appeal

1. Within 90 days from the date of receipt of the last correspondence (result or letter of denial of request) made by the State / Central Public Information Officer or reversal of the due date
2. If the reason for not informing the appellant is first accepted by the appellate authority, the appeal can be made after 90 days.

Writing an application for the first appeal

1. Write your application on a piece of white paper
2. The application can be either handwritten or typed.
3. The application should be in English or Hindi (if you want to send it to the Central Information Commission) or in the official language of that particular state (if you want to send it to the State Information Commission).
4. The required information should be clearly mentioned in the prescribed form in the application.
5. Request form, proof of payment of fee, acknowledgment given by Public Information Officer, result given on the application, etc. Attach self attested photocopies of documents with the application.
6. Make photocopies of each document and keep them for your own reference.

Where to send the first appeal form

1. The application should be submitted to the First Appellate Authority of the same establishment.
2. The first appellate officer in the category is an officer of a higher rank than the public information officer and the assistant information officer who provides the required information or may reject the application.
3. When filing the first appellate application, check the name of the first appellate officer, the fee, the method of payment of the fee. (In some states, the first appeal is free, while in some states a fee is charged.)

How to send the first appeal form

• Applications should be sent only by registered post or by hand.
• Avoid using courier services.
• Also attach the acknowledgment with the application.
• Time limit for providing information:
• In general cases, a decision is usually given within 30 days. In exceptional cases this limit can be extended to 45 days.
• The time limit for decision is calculated from the day the application is first received by the Appellate Authority.
